Terms of Service

1. Provider and scope
ClipDelta is provided by Dario Kiener, Kirchweg 55, 3255 Rapperswil BE, Switzerland. Contact: support@clipdelta.app. These terms apply to the ClipDelta website, accounts, workspaces and analytics services.
2. The service
ClipDelta helps creators analyse and compare short-form video performance. Depending on availability, users may connect third-party platform accounts, import performance data, add data manually or by screenshot, and request AI-assisted observations and suggestions. ClipDelta does not post, edit or delete content on connected social platforms unless a separate feature explicitly states this and the user authorises it.
3. Accounts and connected platforms
Users must provide accurate information, protect access to their account and only connect platform accounts they are authorised to use. Connections can be revoked in ClipDelta or through the relevant platform. Third-party services, including Meta, Google/YouTube and TikTok, remain subject to their own terms and availability.
You must be at least 18 years old, or otherwise legally capable of entering into this agreement in your country. If you use ClipDelta for an organisation or another person, you confirm that you have authority to bind them and to permit the processing of the connected accounts and data.
4. Permitted use
ClipDelta may not be used unlawfully, to infringe third-party rights, to bypass platform restrictions, to obtain unauthorised access, or to disrupt or reverse engineer the service. Automated access is permitted only through interfaces expressly provided by ClipDelta.
5. Analytics and AI output
Metrics imported automatically from a connected platform, extracted from a screenshot or entered manually originate from third-party or user-provided sources. Platforms may delay, omit, revise or define metrics differently, and screenshot recognition or assignment to an account, video, reporting period or measurement time can be incorrect. Users are responsible for checking the selected source, account, video, reporting period and imported values before relying on them. ClipDelta analyses and AI-generated recommendations are decision support, not guarantees of data completeness, reach, revenue or business results. They are not legal, financial, tax or other regulated professional advice.
6. Plans, payment and cancellation
Paid plans are sold and billed by Lemon Squeezy as merchant of record. Prices, taxes, renewal periods and the applicable checkout conditions are shown before purchase. Users can manage or cancel a subscription through the billing portal. Cancellation stops future renewal; access normally continues until the end of the paid period. Refunds, statutory withdrawal rights and exceptions for digital services depend on the checkout terms and the mandatory law that applies to the customer. Nothing in these terms limits a mandatory refund, withdrawal, cancellation or other consumer right.
7. User content and intellectual property
Users retain their rights in content and data they provide. They grant ClipDelta the limited rights needed to process that material and operate requested features. ClipDelta software, branding and original service content remain protected by applicable intellectual-property law.
8. Availability and changes
We aim to provide a reliable service but cannot guarantee uninterrupted availability. Features may be changed for security, legal, platform-policy or product reasons. Material changes that adversely affect a paid plan will be communicated where reasonably possible.
ClipDelta is provided on an as-available basis. To the extent permitted by law, we do not warrant that imported third-party data is complete, current or error-free, that every platform metric will remain available, or that analyses will produce a particular commercial result.
9. Suspension and termination
Access may be suspended or terminated for serious or repeated violations, security risks, non-payment, or where required by law or a platform provider. Users may stop using ClipDelta at any time and may request account deletion subject to legal retention obligations.
10. Liability
To the extent permitted by law, ClipDelta is not liable for indirect or consequential loss, or for losses caused by unavailable, delayed, incomplete, revised, incorrectly imported or incorrectly assigned platform data or user-provided data. This includes data imported through platform APIs, screenshots and manual entry, as well as decisions made from analyses based on that data. Liability that cannot legally be excluded, including liability for intent or gross negligence and mandatory consumer rights, remains unaffected.
11. Privacy
Personal data is handled as described in the ClipDelta Privacy Policy.
12. Governing law
Swiss law applies, without prejudice to mandatory consumer protections. Where legally permitted, the courts at the provider's domicile have jurisdiction.
13. General terms
If a provision is invalid or unenforceable, the remaining provisions remain in effect and the invalid provision applies only to the maximum extent permitted by law. A failure to enforce a provision is not a waiver. We may update these terms for legal, security, platform-policy or service changes. Material changes will be announced in an appropriate manner before they take effect where required. Questions and notices can be sent to support@clipdelta.app.
